Please read these terms carefully before using Customer Support AI Monitor.

1. Acceptance of Terms

By accessing or using Customer Support AI Monitor ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

Customer Support AI Monitor is a SaaS platform that helps customer support teams:

  • Track and analyze CSAT (Customer Satisfaction) scores
  • Monitor AI chatbot escalations and performance
  • Identify knowledge gaps in AI responses
  • Calculate and demonstrate ROI from AI chatbot investments
  • Integrate with customer support platforms (e.g., Zendesk)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account Registration

Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service. By creating an account, you represent and warrant that you meet these requirements.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and enabling multi-factor authentication when available

Account Responsibility

You are solely responsible for all content, data, and activities associated with your account. We are not liable for any loss or damage arising from your failure to comply with this section.

4. Subscription and Billing

Plans and Pricing

We offer various subscription plans with different features and usage limits. Current pricing is available on our pricing page. We reserve the right to change our pricing with 30 days' notice to existing customers.

Payment Terms

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed securely through Stripe
  • All fees are non-refundable except as required by law or as explicitly stated
  • You authorize us to charge your payment method for all fees

Renewal and Cancellation

Subscriptions automatically renew unless cancelled at least 7 days before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Refund Policy

We offer a 7-day free trial for new customers. After the trial period, subscriptions are non-refundable. Refunds may be provided at our sole discretion in exceptional circumstances.

Overages

If you exceed your plan's usage limits, we may charge overage fees or suspend your account until you upgrade to a higher plan. Overage fees will be clearly communicated before charges are applied.

5. Use of Service

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam or unsolicited communications
  • Impersonate any person or entity

Prohibited Activities

The following activities are strictly prohibited:

  • Reverse engineering, decompiling, or disassembling the Service
  • Scraping, crawling, or harvesting data from the Service
  • Using automated systems to access the Service without authorization
  • Sharing your account credentials with others
  • Reselling or redistributing the Service without authorization

API Usage Limits

If you use our API, you must comply with rate limits and usage restrictions. Excessive API usage may result in throttling or suspension of API access. We reserve the right to modify API limits at any time.

6. Intellectual Property

Our Rights

The Service, including all content, features, functionality, and software, is owned by Customer Support AI Monitor and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content, data, or information you submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing the Service.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription period.

7. Data and Privacy

Data Ownership

You own all data that you submit to the Service. We do not claim ownership of your data. However, you grant us the right to use your data as necessary to provide, maintain, and improve the Service.

Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.

8. Service Availability

Uptime SLA

We strive to maintain 99.9% uptime for our Service. Enterprise plan customers are entitled to specific SLA guarantees as outlined in their service agreement.

Maintenance

We may perform scheduled maintenance that may temporarily interrupt the Service. We will provide reasonable notice of scheduled maintenance when possible.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOMER SUPPORT AI MONITOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Customer Support AI Monitor, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your Content or any content you submit to the Service

11. Termination

By You

You may terminate your account at any time by cancelling your subscription through your account settings or by contacting us at support@csmmonitor.ai.

By Us

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in any fraudulent, illegal, or harmful activity.

Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data in accordance with our data retention policies. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

12. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending an email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
